After an attorney sued another attorney in a class action malpractice lawsuit, the defendant attorney cross complained against the class action attorney for “solicitation” of clients. Charles Grebing moved to strike the defendant attorney’s cross-complaint pursuant to the Anti-SLAPP statute, which is designed to address lawsuits that impinge upon the rights of petition and free speech. Mr. Grebing also obtained an award of more than $24,000 in attorney fees and costs, which represented 100 percent of the fees and costs incurred to defend the action. The grant of the SLAPP motion followed the defeat of a motion for preliminary injunction on First Amendment grounds.
