Charles Grebing and Colin Walshok recently obtained a dismissal of a claim filed against their client, an alternative dispute resolution provider, in the United States District Court for the Northern District of California. Wingert Grebing filed a Rule 12(b)(1) and 12(b)(6) motion to dismiss plaintiffs’ complaint based on lack of standing under the Lanham Act. The District Court granted the motion and published the decision. By prevailing on the motion, Wingert Grebing was able to save its client from protracted and expensive litigation relating to a false advertising claim.
