Charles Grebing and Colin Walshok recently successfully opposed a motion for summary judgment in a landlord tenant dispute relating to the tenants obligations to defend and indemnify their landlord. The tenants filed a motion for summary judgment asserting they had no obligation to indemnify the landlord based on the language of the indemnity provision. Wingert Grebing filed a motion for summary adjudication contending the tenants owed an immediate duty to defend the landlord. The Court denied the tenants motion for summary judgment and granted Wingert Grebing’s motion for summary adjudication.
