Alan Brubaker & Ian Friedman represented a novice horsewoman who was thrown from a horse and severely injured her ankle during a horseback riding lesson. The firm’s client signed a waiver and release before commencing the lessons. The firm took the position the defendant engaged in grossly negligent conduct which substantially increased the ordinary risks associated with taking horseback riding lessons. After defeating the defendant’s summary judgment motion which focused on the signed waiver and release, the firm was able to obtain a favorable result for the client.
