Plaintiffs filed a class action against a San Diego-based real estate broker, it’s agents, and a third-party real estate services company in Contra Costa County. Plaintiffs alleged venue was proper in Contra Costa County because the third party defendant real estate services company maintained its executive office in that County. All plaintiffs, the real estate broker and its agents were San Diego County residents. The Court granted Grebing and Friedman’s Motion to Transfer Venue finding this was a consumer action relating to the provision of household services and Code of Civil Procedure section 395(b) requires that action be brought in the County of Plaintiffs’ residence which in this case was San Diego.
