Grebing and Friedman defended a San Diego law firm against a complaint brought by the Firm’s former clients for legal malpractice and breach of fiduciary duty. The former clients sought punitive damages alleging the Firm mishandled a non-judicial foreclosure in the context of a much broader family farming dispute the Firm had been retained to handle. The Firm cross-complained for past-due contractual attorney’s fees.
After the Plaintiffs completed their evidence following a nine-day jury trial, the Court granted Wingert Grebing’s nonsuit motion dismissing the Complaint in its entirety by finding Plaintiffs failed to support their claims with any evidence. The case therefore only went to the jury on the Firm’s cross-complaint for attorneys’ fees. The jury awarded the Firm $650,000.
