Wingert Grebing represented an attorney and his law firm that were sued by a non-client. The operative cross-complaint alleged legal malpractice and sought equitable indemnity because of Wingert Grebing’s clients’ advocacy in related proceedings. Wingert Grebing’s successful motion under California’s anti-SLAPP statute showed all allegations arose from protected litigation activities and none of the causes of action had any probability of prevailing on the merits. With the cross-complaint struck, Wingert Grebing will now seek statutory prevailing attorney fees and costs for its clients.
