The Court of Appeal recently affirmed a 2019 jury verdict Charles Grebing and Ian Friedman obtained defending a San Diego law firm against a complaint brought by the Firm’s former clients for legal malpractice and breach of fiduciary duty. The former clients sought punitive damages alleging the Firm mishandled a non-judicial foreclosure in the context of a much broader family farming dispute. The Firm cross-complained for past-due contractual attorney’s fees.
Wingert Grebing briefed and argued the appeal with the Court of Appeal affirming the trial court decision granting a nonsuit motion dismissing the Complaint in its entirety by finding Plaintiffs failed to support their claims with any evidence. The Court of Appeal also affirmed the portion of the judgement awarding Wingert Grebing’s client $650,000 in attorneys’ fees plus well over $100,000 in cost of proof sanctions.
